Permits Required

The following is a list of permits required by MA 527 CMR 1. For details on any specific requirements or process for permitting please contact the fire prevention office at 978-597-8150 or fireprevention@townsendfire-ems.org.

Under 527 CMR 1.00 (Massachusetts Comprehensive Fire Safety Code), Section 1.12.8, permits are categorized by specific high-risk processes, hazardous material quantities, and fire protection operations.

1. General & Open Flame Operations (§ 1.12.8.1, § 10.10)

  • Open Air Burning: Burning of brush or agricultural debris (subject to local seasonal restrictions).
  • Ceremonial Bonfires: Public or organizational ceremonial fires.
  • Torch-Applied Operations: Using open flame torches for paint removal or applying torch-down roofing materials.

2. Hot Work & Industrial Heating (§ 1.12.8.2, § 1.12.8.23, § 1.12.8.31)

  • Cutting & Welding (Hot Work): Operating oxy-fuel torches, arc welders, or thermal cutting equipment in commercial, industrial, or multi-family settings.
  • Oil Burners & Fuel Lines: Installing, modifying, or removing oil-burning equipment, fuel storage tanks, and associated oil safety valves.
  • Industrial Ovens & Furnaces: Operation of high-heat industrial baking, drying, or heat-treating equipment.

3. Hazardous Materials & Storage (Table 1.12.8.50, § 1.12.8.34–.43)

  • Flammable & Combustible Liquids: Storing or using Class I, II, or III liquids exceeding state threshold quantities (e.g., gasoline, solvents, diesel, heating oils).
  • Compressed & Cryogenic Gases: Storing or connecting flammable, oxidizing, toxic, or inert compressed gas cylinders and liquid oxygen/nitrogen dewars.
  • Liquefied Petroleum Gas (LP-Gas) & LNG: Installing, connecting, or storing propane tanks/cylinders for commercial or bulk residential use.
  • Flammable Solids & Aerosols: Storing regulated quantities of ignitable solids or Level 2/3 aerosol products.

4. Explosives, Pyrotechnics & Ammunition (§ 1.12.8.39, Table 1.12.8.50)

  • Explosives & Blasting: Transporting, storing in magazines, or detonating commercial explosives and dynamite.
  • Fireworks & Special Effects: Public displays of fireworks, flame effects, or pyrotechnics (requires a state-certified pyrotechnician).
  • Ammunition & Black Powder: Storing commercial volumes of small arms ammunition, smokeless propellants, or black powder.

5. Fire Protection & Life Safety Systems (§ 1.12.8.3, § 13.1.8)

  • System Disconnection / Modification: Disconnecting, shutting off, removing, or altering any fire sprinkler system, standpipe, fire alarm, or carbon monoxide detection system.
  • System Construction / Rehabilitation: Installing or modifying fire suppression and fire alarm infrastructure prior to work commencing.

6. Refueling, Motor Fuels & Garages (§ 1.12.8.16, § 1.12.8.24–.26, § 42.2.2.1)

  • Motor Fuel Dispensing: Operating commercial fleet refueling, service station pumps, or repair garages.
  • Tank Vehicles & Transfer Tanks: Storing or dispensing fuel directly from cargo tanks, portable tanks, or marine fueling piers.

7. Commercial Operations & Special Facilities

  • Commercial Cooking Operations (§ 1.12.8.30): Installing or modifying commercial kitchen hood fire suppression systems.
  • Spray Application / Dipping (§ 1.12.8.27): Operating spray paint booths or dip tanks using flammable/combustible liquids.
  • Cleanrooms & Dry Cleaning Facilities (§ 1.12.8.9–.10): Operating commercial dry cleaning plants or solvent-based cleanrooms.
  • Energy Storage Systems (ESS) (§ 1.12.8.32): Installing commercial battery energy storage systems.
  • Dumpsters & Waste Refuse (§ 1.12.8.5): Placing large mechanical rubbish containers or dumpsters in close proximity to structures.

Important Regulatory Thresholds: Permit vs. License

  • Permit: Issued directly by the Head of the Fire Department (the local AHJ) for specified activities and storage amounts.
  • License (Table 1.12.8.50 / M.G.L. c. 148 § 13): If the aggregate volume of flammable or combustible materials on a single property exceeds higher statutory thresholds, a Land License must be granted by the local municipal licensing board in addition to maintaining an annual fire department permit.
